Returns and Refund

  1. Introduction

1.1 This policy sets out the circumstances under which products may be returned to us, PDQLogic Limited. It shall apply to all of our customers, irrespective of their geographical location.

  1. Cancellation

2.1 You will not be entitled to cancel or return an order once it has been placed (unless the products are found to be defective, in accordance with clause 4).

  1. Damage to Goods in Transit

3.1 Any damage to goods in transit should be notified to us according to the defect policy set out in clause 4. We shall not be liable for any claim or damage unless notification is received in accordance with these Terms.

3.2 Our liability shall be limited to the price of the damaged goods.

  1. Defective Product

4.1 We warrant our products against defects in materials and workmanship under normal use for a period of one year from date of shipment (the “Warranty Period“). If a defect arises and a valid claim is received within the Warranty Period, we will, at our option and to the extent permitted by law, for any products that are returned and confirmed by us to be non-conforming to the order specifications and/or the applicable quality and acceptability standards, either (i) replace the product at no charge or (ii) issue a credit equal to the original purchase price of the product. When a product is exchanged, any replacement item becomes your property and the replaced item becomes our property. When a refund is given, the product for which the refund is provided must be returned to us and becomes our property. We will not accept liability for any cost in addition to the value of the product including but not limited to components, labour, business interruptions and any other consequential damages or losses.

4.2 In the event of any claim that the goods are defective as to their quality or condition or fail to correspond with any agreed specification or other term of our Terms and Condition of Sale, you must:

4.2.1 notify us in writing within the Warranty Period of your intention to return the goods (the “Notification Date”); and

4.2.2 return the goods to us, together with a written report detailing the reason for rejection within 4 weeks from the Notification Date.

4.3 Time shall be of the essence in respect of clause 4.2, and a failure to comply with clause 4.2 shall mean that we shall not be liable in any way to you and that you will remain responsible for the price of the goods as if they had been delivered fully in accordance with our Terms and Condition of Sale.

4.4 This limited warranty does not apply: (a) to damage caused by use with products not supplied by us; (b) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (c) to damage caused by use of the product outside the permitted or intended uses described in the product specifications; (d) to damage caused by service (including upgrades and expansions) performed by anyone who is not our representative; (e) to a product or part that has been modified to alter functionality or capability without our written permission; or (f) to cosmetic damage, including but not limited to scratches or dents, that does not otherwise affect the product’s functionality or materially impair it’s use.

4.5 Complaints by you in respect of goods alleged to be defective shall not be a valid reason for non-payment of any other amounts due from you. There are no rights of set-off or withholding of payments due from you to us.

4.6 In the event that you wish to return a product for any reason, you shall be the responsible for paying the delivery costs of the return of the product to us. However, if we find that the product was defective in accordance with the terms of this agreement, we will refund all reasonable delivery charges, on providing proof of the same.

  1. Refunds

5.1 We will give you a refund for the price you paid to us in respect of any product properly returned by you in accordance with this policy.

5.4 We will usually refund any money received from you using the same method originally used by you to pay for your purchase.

5.5 We will process the refund due to you as soon as possible and, in any event, within 30 days following the day we receive your returned product.
